Banksy, battaglia legale sul marchio: l’artista avrebbe “agito in mala fede”
Potrebbe essere a rischio il marchio “Banksy” dopo che l’anonimo street artist britannico ha perso una battaglia legale per l’utilizzo dell’immagine di una sua opera. Il caso, cominciato due anni fa, opponeva Banksy a una piccola azienda inglese, la Full Colour Black, che aveva adoperato la famosa immagine del Flower Thrower per una cartolina d’auguri da mettere in vendita (l’attività dell’azienda è proprio quella della vendita di cartoline augurali).
Il verdetto è arrivato il 14 settembre dopo due anni di battaglie legali. In breve, l’Ufficio dell’Unione europea per la proprietà intellettuale (EUIPO) ha stabilito che Banksy non può vantare diritti sull’immagine, perché ha sempre scelto di rimanere anonimo, e di conseguenza non può essere riconosciuto come il legittimo proprietario dell’opera. Si tratta di una sottile differenza tra marchio e diritto d’autore: il marchio può essere registrato da chiunque, mentre invece, per poter esercitare il proprio copyright, è necessario che l’autore si dichiari in prima persona proprietario dell’opera (e dunque, essendo Banksy anonimo, in linea teorica chiunque potrebbe rivendicare i suoi lavori).
Secondo la tesi dell’EUIPO, Banksy, ha aggirato le leggi sul diritto d’autore che gli avrebbero imposto di uscire dall’anonimato; in effetti i diritti inerenti le sue opere vengono tutelati ed amministrati da una società inglese: la Pest Control Office Ltd.
Banksy è lo pseudonimo utilizzato da quello che, ad oggi, è uno dei più famosi street artists e writers viventi. Iniziata la sua “carriera” sui muri della città di Bristol, l’autore ha sempre realizzato opere a sfondo satirico riguardanti la politica, la cultura e l’etica, raggiungendo una tale notorietà da fare sì che, nel corso di un’asta di Sotheby’s a Londra, il suo quadro “Ragazza con Palloncino” sia stato aggiudicato per oltre un milione di sterline.
